Terms of Service

1. What the service is, and isn't

DamageScore looks at a photo you send and returns a damage score from 0 to 100, a short explanation, a typical repair cost range for your area, and a suggested next step. The score and cost range are generated by an automated system, including artificial intelligence, from the photo and the zip code you give us.

It is an estimate, not an inspection. We are not contractors, inspectors, engineers, insurers, insurance agents, or public adjusters, and nothing we send you is professional, engineering, legal, financial, or insurance advice. A photo cannot show everything. Before you spend money, rely on a licensed professional who has seen the problem in person. Always have a licensed professional inspect damage before making repair, safety, or insurance decisions, and don't delay getting help because of a score: a low score does not mean damage is safe to leave. Cost ranges are typical figures and are not quotes or guarantees.

We never tell you whether to file an insurance claim. Where damage looks sudden and expensive we may point you to a licensed public adjuster. Whether to contact one, and whether to file a claim, is entirely your decision.

2. Who can use it

You must be at least 18 years old, located in the United States, and either own the property in the photo or have permission from the owner to seek repair information about it. You may use DamageScore only for property you have a legitimate interest in.

3. Your photos and the license you give us

You keep ownership of your photos. You promise that you took the photo or otherwise have the right to submit it, and that submitting it and letting us use it as described here does not violate anyone's rights.

License. By submitting a photo to DamageScore in any way, including by text message, email, or the upload form, you grant Northwoods Ventures LLC and its successors a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, store, crop, resize, modify, adapt, analyze, publish, distribute, publicly display, and create derivative works from the photo and the score, explanation, and other results we generate from it, in any medium or format now known or later developed. This includes use on the DamageScore website, in "recent scores" and similar listings, on social media, and in advertising, marketing, and promotional materials, with or without attribution, and without payment to you. You waive any right to inspect or approve such uses.

What we will not do. We remove location metadata from every photo before storing it. We do not publish photos that show faces, people, house numbers, or license plates, and we do not publish your name, phone number, or email address with a photo.

Withdrawal. You may ask us to stop future public use of a photo at any time by texting WITHDRAW to 888-311-5119 from the phone that sent it, or by using the withdraw link on your results page. We will remove the photo from our website and from future marketing within 30 days and delete our copies after that, except copies we must keep for legal or record-keeping purposes. Copies that were already published or distributed before your request, including on social media or by third parties, may continue to exist and we cannot guarantee their removal.

Do not send photos of people, photos of property you do not have the right to photograph, or anything unlawful, private, or intended to harass. We may refuse, remove, or hold any photo at our discretion.

4. Your consent to hear from us

Text messages. We text you only when you ask us to. If you text a photo to 888-311-5119, we reply about that photo: a message asking you to reply YES to these terms, your score link, and, if needed, a question about your zip code or a request for a clearer photo. If you ask us to text you your results link from your results page, we send that one message. These texts are not marketing, and texting us does not sign you up for marketing texts.

Tips and alerts by text (optional). If you check the "also text me" box on your results page (never checked for you, and not needed to get your score), you agree to receive automated informational and marketing text messages from DamageScore (Northwoods Ventures LLC) at that number, such as home maintenance tips, reminders, and severe weather alerts for your area. Consent to marketing texts is not a condition of purchasing anything. Reply STOP to any text to stop.

Email. If you email us a photo, or ask us to email you your results link, we send your link and may send informational and marketing email, such as tips and storm alerts, to that address. Every marketing email includes an unsubscribe link.

5. Text message program terms

Program: DamageScore score texts, operated by Northwoods Ventures LLC. Number: 888-311-5119. We text you about the photo you sent and your Damage Score. We never text you offers from contractors or other companies.

• How you opt in. By texting a photo to 888-311-5119; our first reply confirms it and tells you how to stop. Or by entering your mobile number on your results page and tapping "Text me the link," which sends that one text.
• Message frequency. Usually 2 to 4 messages for each photo you send. If you also checked the optional tips box, we send occasional tips and alerts, no more than 8 messages a month in total unless you ask us something.
• Message and data rates may apply. Your carrier's standard charges apply to messages you send and receive.
• To stop: reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You will get one confirmation text and no further messages. To withdraw a photo from public use without stopping messages, reply WITHDRAW.
• For help: reply HELP, or email support@damagescore.com.
• Carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon, and most others in the United States.
• Your mobile number is handled as described in our Privacy Policy. We do not share it with third parties or affiliates for their marketing.

6. Quotes, contractor networks, and sponsors

If you ask for quotes, we pass your name, phone number, email (if given), zip code, and the type of work to a contractor referral network or, in some areas, directly to a local pro. Those businesses are independent third parties. We do not perform, supervise, warrant, or guarantee any work, price, license, or insurance, and any agreement you make is between you and them.

How we are paid. Contractor networks may pay us when you submit a request. Some businesses shown on our site, including "featured pro" and public adjuster listings, pay us for placement. Payment never changes your score, and a listing is not an endorsement.

7. Acceptable use

Don't use DamageScore to send unlawful content, to submit photos you have no right to submit, to impersonate anyone, to harass, to scrape or copy our content, to interfere with the service, or for any commercial purpose other than evaluating your own property. We may limit or end your access for any of these.

8. Disclaimers and limits on our liability

THE SERVICE, AND EVERYTHING IT PRODUCES, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCORES AND COST RANGES MAY BE WRONG. YOU USE THEM AT YOUR OWN RISK.

TO THE FULLEST EXTENT THE LAW ALLOWS, NORTHWOODS VENTURES LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROPERTY, PROFITS, OR DATA, ARISING FROM THE SERVICE, A SCORE, A COST RANGE, A REFERRAL, OR WORK DONE BY ANY THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some states do not allow some of these limits, so some may not apply to you.

You agree to defend and hold Northwoods Ventures LLC harmless from claims arising from a photo you submit, your breach of these terms, or your dealings with any contractor, network, or adjuster.

9. Changes and ending the service

We may change these terms. The version and effective date appear at the top of this page, and each consent you give is recorded with the version in force at the time. Continued use after a change means you accept it. We may suspend or end the service at any time.

10. Governing law

These terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Connecticut, to whose jurisdiction you consent.
